Terms of Service

These Terms of Service (“Terms”) govern your access to and use of AigentzyOS, a marketing automation platform operated by Make It Real GmbH, a company registered in Switzerland.


By accessing or using AigentzyOS, you agree to be legally bound by these Terms. If you do not agree, you may not access or use the platform.




1. Definitions



  • “AigentzyOS” refers to the web-based software platform available at https://aigentzy.io, developed and operated by Make It Real GmbH.
  • “We”, “Us”, “Our” refers to Make It Real GmbH.
  • “User”, “You” means any individual or entity that registers for or uses AigentzyOS.
  • “Subscription” means the selected pricing plan (e.g., Free, Pro, Team, Enterprise), including any associated credit allocations and features.





2. Eligibility



You may use AigentzyOS only if you:


  • Are at least 18 years old, and
  • Have the legal authority to enter into these Terms, either for yourself or on behalf of an organization



If you access AigentzyOS on behalf of a company or organization, you represent that you are authorized to accept these Terms on its behalf.




3. Services



AigentzyOS offers:


  • AI-powered marketing campaign creation and automation
  • Integration with social media platforms (e.g., TikTok, X, Instagram)
  • Credit-based content generation (images, videos, text)
  • Dashboard features including KPIs, timelines, and campaign scheduling



We reserve the right to improve, update, limit, or discontinue parts of the platform at our discretion.




4. Account Registration



To access most features, you must register an account and provide accurate, up-to-date information. You agree to:


  • Keep your login credentials secure
  • Notify us immediately at contact@aigentzy.io if you suspect unauthorized use
  • Accept responsibility for all activity under your account



We reserve the right to suspend or terminate accounts in case of misuse or breach.




5. Subscriptions, Pricing & Credits



  • AigentzyOS offers subscription plans with different features and credit allowances, described at https://aigentzy.io/pricing
  • Usage of certain features (e.g., video creation, image generation) consumes credits
  • Subscriptions renew automatically unless cancelled prior to renewal
  • Payments are securely processed via third-party providers
  • All prices are in CHF or EUR and may be subject to VAT depending on your country





6. Free Plan & Trials



We may offer a free plan or time-limited trials. We reserve the right to modify or terminate such offers at any time without notice.




7. Intellectual Property



All intellectual property related to AigentzyOS, including code, UI/UX, trademarks, and generated tools, remains the exclusive property of Make It Real GmbH.


You may not:


  • Reverse engineer or decompile AigentzyOS
  • Copy or redistribute platform components without written consent
  • Infringe on copyrights or trademarks of Aigentzy or others



You retain rights to content you legally upload or generate.




8. User Conduct & Content



You agree not to:


  • Use AigentzyOS to distribute unlawful, harmful, or infringing content
  • Violate any third-party rights, including copyrights or terms of connected social platforms
  • Circumvent, disable, or tamper with security-related features
  • Use AI-generated content for deceptive or malicious purposes



We may suspend access for violations of these Terms.




9. Data Protection



Use of AigentzyOS is subject to our Privacy Policy, which explains how we collect, store, and use personal data in accordance with Swiss and international privacy laws.




10. Third-Party Services



AigentzyOS may integrate with external platforms (e.g., social media APIs, analytics tools). Use of these features is governed by the third parties’ own terms and privacy policies.


We are not liable for data loss, restrictions, or changes caused by these third-party services.




11. Termination



You may terminate your subscription or account at any time. We reserve the right to suspend or delete your account if:


  • You breach these Terms
  • You misuse the platform
  • Required payments are overdue



Upon termination, your access to AigentzyOS and unused credits will be revoked. No refunds are granted for partial billing cycles unless required by law.




12. Liability & Disclaimers



AigentzyOS is provided “as is”. To the extent permitted by law, we disclaim all warranties, express or implied. We are not liable for:


  • Loss of profits, business, or data
  • Platform outages or errors
  • Third-party service disruptions



Our total liability is limited to the amount paid for your last subscription cycle.




13. Governing Law & Jurisdiction



These Terms are governed by the laws of Switzerland, excluding conflict of law principles.


Exclusive place of jurisdiction is Gansingen, Aargau, Switzerland, unless otherwise required by mandatory law.




14. Changes to These Terms



We may update these Terms from time to time. Significant changes will be communicated on our website or via email. Continued use of the platform constitutes acceptance of the updated Terms.
